Our private and public contracts practice involves providing legal assistance to clients in the drafting, negotiating, and enforcement of a wide range of contract types.
The law firm’s private contracts practice would involve advising clients on the legal aspects of contracts primarily in the commercial field, such as non-disclosure, distribution, sale and purchase of property, including the terms and conditions, potential risks, and liability issues. The lawyers of emlex would work closely with their clients to ensure that the contract accurately reflects their intentions and protects their interests, always considering their specific business context. If we are not familiar with it, our standard approach is first to get acquainted with the specificities of our clients’ business, in order to devise contractual schemes that can actually work in practice. We have refined our skills over decades of experience and are able to deal with all sorts of innovative and a-typical contractual schemes and models. We tailor contracts for the clients’ needs.
Public contracts, on the other hand, involve agreements between public agencies and/or a private party and a public agency. Examples of public contracts include public procurement contracts, public-private partnership agreements and other public agreements such as concessions and conventions. Our public contracts practice focuses on advising clients on the legal requirements and regulations involved in these contracts, including compliance with public procurement rules and bidding procedures and includes, especially in the set of construction related agreements (design and engineering, construction and all services related to the construction process), all the ancillary accomplishments that accompany the contract itself (the preparation of the tender, the assistance to all the phases of the bid and the preparation and negotiation, if any, of the public agreement).
In both private and public contracts practice, our services include contract drafting, reviewing and negotiating contract terms, advising on legal risks and compliance issues, assisting with contract disputes, and representing clients in litigation, including before the administrative courts, or arbitration proceedings.
The experience of our lawyers in this area is enhanced by the recurring appointment of some of emlex’s lawyers as arbitrators in complex civil and commercial disputes.
