The IP/IT department of emlex is capable of helping clients have control of the multifaceted legal landscape of technology transfer. We have worked with a wide range of clients, including universities, research institutions, start-ups, and established companies, to help them protect and commercialize their intellectual property. In particular our expertise has been refined with respect to a number of high-profile research programs run by research centres privately funded by companies active in the life-science sector.

We have also worked with higher education institutions. We have a deep understanding of the unique challenges that universities and research institutions face when it comes to technology transfer, including issues related to ownership of intellectual property, licensing agreements, and the commercialization of innovative technologies.

We have experience negotiating licensing agreements, conducting due diligence, and advising clients on the best strategies for protecting their intellectual property.

We are also well-versed in the various laws and regulations governing technology transfer, including EU and national laws related to patents, trademarks, and copyrights.

We have followed EU funded research and development projects in the interest of private companies and have a track record of helping clients navigate these complex legal frameworks, ensuring that they are able to protect their intellectual property and maximize the value of their innovations, while complying with the requirements of the public funding institutions, to preserve public expenditure.

We are capabilities also cover technology-transfer competition-law related issues, in particular as it concerns transfer arrangements between direct competitors or their participation in standard setting organizations and the obligation to provide access to technology of fair, reasonable and non discriminatory terms (FRAND), when a company holds a position of dominance over a particular type of technology. Of course we are also established litigators in this field.

Finally, thanks to our long-lasting relationship with the academic world and community, the added value emlex offers is deep understanding of the dynamics and interests underpinning research institutions, in particular when interfacing with private parties that provide the necessary funds.
